Terms and Conditions

All customers booking dive excursions with ShutterFish must show proof of certification (through their relevant training agency) to the minimum level required before they are able to dive. If you are unable to provide proof of certification, you will not be able to dive and may forfeit all deposits paid.

The Client acknowledges being aware of the proposed trip/course and hereby confirms that he or she is medically fit, in good health and is able to embark upon the trip/course. Any Client with a pre-existing medical condition or illness must declare the true nature of such condition at the time of booking. Such a Client would be required to provide a medical statement from a General Practitioner stating that they are “medical fit to undertake scuba Diving and/or Snorkeling”. We will treat any information in the strictest confidence.

Clients should be aware that our team may take photographs or films of the Clients while on any of the tours and ShutterFish reserves the right to use such material for any advertising or brochure production without obtaining consent and without payment to the Client.

All our ocean expeditions are from a boat, seasickness is extremely common and can happen to even those who have previous sea experiences. The Client assumes all responsibility for preventive measures, Shutterfish assumes no liability for seasickness and its implications.  We are not legally allowed to provide medical advice to prevent and treat seasickness.

This Privacy Policy describes how epicdivingmexico.com (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

MINORS


The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

Refund policy
 

In order to provide you with the highest standards in quality, safety and satisfaction, we are not safe from any unexpected events that might happen before or during your vacation, the information below sets forth the Refund & Cancellation Policy of online pre-bookings.

Any cancellation within 48 hours of your activity date is non-refundable. For a full refund, we must be notified 3 days prior to your scheduled activity ( 7 days for high seasons such as Christmas, Easter, Thanksgiving and New Years) This is as a courtesy to open up space for guests who might be waiting in line for our activities.
No show: no refund
Refunds can only be processed via the same means of payment. Will be subjected to all processing fees incurred on the initial transaction (PayPal fees or credit card companies) The accreditation terms are subject to existing bank clearing regulations, which are not controlled by Shutterfish. In some cases, it may take up to 45 days to see the refund reflected on your account due to country and bank regulations.
All our activities are highly weather dependent and Shutterfish reserves the right in any circumstances to cancel the tour, remember your safety is the most important thing for us.  In instances where we cannot provide the tour booked, we will return to the client all deposits paid or may offer the Client an alternative trip. If an alternative trip is refused by the client we do a total refund.
In case of cancellations of services purchased through another website or agency, please contact them directly and follow their Refund & Cancellation Policy.

Cancellations due to sickness or other medical conditions preventing clients from doing the activity: we would request a written statement from a doctor, in which case we will do everything possible to reschedule without extra cost. If rescheduling isn’t possible at that time, the client shall receive a full refund.
The decision of the driver, Divemaster or Instructor will be final on all matters likely to endanger the safety of the group. we shall not be responsible for or liable to any Client who commits an illegal or unlawful act in any way. The Client may be excluded from the trip/course without any refund of the trip/tour. If Shutterfish considers the Client unsuitable for a trip/tour, it may in its absolute discretion cancel such Client’s booking or decline to carry the Client further if that Client causes danger, inconvenience or annoyance to other clients. If Clients are found to be under the influence of alcohol/drugs prior to an activity tour, the tour will be cancelled with no refund.

For expeditions ( The sea of Cortez)


A 60% deposit is mandatory in order to save your spot in the boat, the rest of the payment needs to be done two months before the date of the trip.

If a cancellation is made at the time of arrival no refund will be issued unless there is a weather condition that prevents us from making the trip. In which case 100 % of the deposit will be refunded. 
If you are unable to arrive on time to the boat, hotel, or are subject to an early departure, there will be a full charge.
If you are unable to arrive at the designated time for the airport transfer, you will be responsible for your transfer.
DAN insurance or equivalent is mandatory
If paying with any foreign currency, prices are subject to change without notice based on market exchange rates. 


For Whale shark, Bull shark, Mantas Encounters


As with all things in nature these experiences are entirely unpredictable, we can not guarantee anything. However, these trips are scheduled during the peak season to optimize the chance of great encounters. We are quite confident that you will get in the water with them.
These activities are highly weather dependent and Shutterfish reserves the right in any circumstances to cancel the tour, remember your safety is the most important thing for us.  In instances where we cannot provide the tour booked, we will return to the client all deposits paid or may offer the Client an alternative trip. If an alternative trip is refused by the client we do a total refund.

For Certification Courses

If a diver cancels his/her dive course, a refund will not be issued for the eLearning or books provided.
If you need another training day (either pool or ocean) an extra charge will be done. 

We understand that at times, you may find that scuba diving is not for you or your instructor may decide that you need further one on one training to complete a diving program. In this instance you will be offered a snorkel program or to return at a later date. This is at the dive instructors discretion. Refunds will not be issued if you find that scuba diving is not for you or if the dive instructor recommends that you return when your swimming skills or confidence in water is more advanced.
